Understanding Theft Crime Charges in Michigan

The type of theft offense a person is charged with, as well as the severity of the penalties associated with the crime, depends on the value of the goods taken, and whether or not the defendant has any prior theft convictions. The higher the value of the goods stolen, the more severe the penalties will be. Our team can analyze your situation and use effective legal strategies to build your case. Whether you are facing misdemeanor theft charges or felony theft charges, we will work tirelessly as you seek a beneficial outcome.

Misdemeanor Theft

There are 2 types of misdemeanor theft offenses in Michigan:

  1. Larceny of goods valued at less than $200
  2. Second-degree theft of goods with a value between $200 and $1,000

A misdemeanor larceny offense is punishable by up to 93 days in jail and a fine of not more than $500, or 3 times the price of the goods taken, whichever is greater. Second-degree misdemeanor theft in Michigan is punishable by up to 1 year in jail and a fine of up to $2,000, or 3 times the price of the goods stolen.

Felony Theft

Just like misdemeanor theft charges, there are 2 levels of felony theft in Michigan. Persons charged with theft of goods with a value between $1,000 and $20,000 face up to 5 years in prison and a fine of up to $10,000, or 3 times the value of the goods taken. Felony theft charges also apply to theft of motor vehicles, trailers, or any motor vehicle part, even when those parts or vehicles are not valued at more than $1,000.

Second-degree felony theft in Michigan applies to goods or services valued at $20,000 or more. It is punishable by up to 10 years in prison and a $15,000 fine, or 3 times the amount of the stolen property value. Prior convictions can greatly impact the guidelines for jail or prison sentencing. Therefore, it is very important to hire a knowledgeable Birmingham criminal defense attorney to aggressively help you throughout this process.
