Birmingham DUI Attorneys
If you or a loved one is dealing with a DUI charge, you’ve likely come to realize just how complicated it is to figure out your rights and defenses. You know you need to take action to protect your record and continue on with your life, but figuring out the right move to make can be tough. Our Birmingham DUI attorneys understand this problem, and we’ve helped many Michigan residents resolve their OWI and DUI charges.
In fighting a driving under the influence (DUI) or operating while intoxicated (OWI) charge, you need to obtain an experienced attorney’s opinion about your case and discuss its strengths and weaknesses. While some may tell you that pleading guilty is all that you can do when it comes to a DUI charge, this isn’t always the best option. In fact, there are circumstances where defending yourself against the charge and/or seeking to have it reduced makes more sense.

Defending Against DUI Charges in Michigan
In the state of Michigan, as in other states, it is illegal to drive with a blood alcohol content (BAC) of .08 or higher. However, there are circumstances where individuals are charged with a DUI, even with a lower BAC, if the officer feels that there is evidence that the driver was inebriated and/or under the influence of something other than alcohol to the extent that they were driving dangerously.
Specifically, it is illegal to drive under the influence of alcohol, illegal drugs, intoxicating compounds, or any combination thereof. So, if police believe you are impaired in any of these ways, you can face a charge of operating while visibly impaired (OWVI) even if your BAC was not as high as .08.
In these circumstances, it is sometimes possible for the DUI to be changed to a lesser offense, such as reckless driving, which does not result in the same severe consequences for your record or driving privileges. If your driver’s license has been suspended and you need your driving privileges back, our Birmingham DUI attorneys may be able to help you challenge the suspension or apply for a hardship license. In every circumstance, it is crucial to analyze the defenses you may have and the strategy that makes the most sense for your case.
